Terms and Conditions
These Terms and Conditions govern the use of Ciudad Viva, a free digital platform to discover, publish and promote events and activities in Chile, available as a website (ciudad-viva.cl) and a mobile app. By creating an account or using the platform, you accept these terms.
1. What Ciudad Viva is
Ciudad Viva lets anyone discover events and activities and —by creating an account— publish their own and/or create and manage an organization to promote their activity on an ongoing basis. Use is free of charge. Ciudad Viva is not limited to municipalities or public bodies: any person or organization can use it on their own (self-service), without contacting us first.
In addition to what users and organizations publish directly, Ciudad Viva incorporates event information publicly available on the websites of municipalities and cultural bodies of the Santiago Metropolitan Region, to expand the available catalog. Ciudad Viva does not organize events published by third parties, does not sell tickets and does not act as an intermediary in the payment or purchase of tickets.
2. Accounts
To publish events or create an organization you need an account, with a name, email and password. By creating an account you declare that you have the legal capacity to accept these terms, or the authorization of your legal representative if you are a minor (see Privacy Policy, §13). You are responsible for keeping your password confidential and for all activity carried out from your account. You must provide enough information for your account to work, and not use third parties' information or create accounts or organizations for impersonation or deception.
You can request the closure of your account by writing to contacto@ciudad-viva.cl (see Privacy Policy, §3.2, for time limits). We may suspend or close an account that breaches these terms, including fraudulent use, identity theft or publishing illegal content.
3. Organizations
Anyone can create an organization to represent an entity, collective, brand or initiative, and manage it together with other members with different access roles. Whoever creates or manages an organization declares that they have the necessary authorization to represent it and is responsible for the accuracy of the public information they publish on its behalf.
An organization may appear as “verified” when the Ciudad Viva team has reviewed its legitimacy. Verification speeds up the publication of its events (automatic approval instead of manual review) and is shown as a public badge, but it does not guarantee that every event it publishes is accurate, safe or takes place as announced. You can delete your organization at any time from its settings; it is hidden immediately and permanently deleted within the following 30 days (see Privacy Policy, §11). Regardless of that, we may suspend or hide an organization that breaches these terms.
4. Publishing events
Any user or organization can publish events. Whoever publishes an event (the “organizer”) is solely responsible for the information being accurate, up to date and compliant with applicable law: dates, times, location, prices and any access requirements. Ciudad Viva does not independently verify every piece of data of every event in advance, except for the moderation process described below.
Events from unverified users or organizations go through a review before being published; we may approve, reject or hide an event, and correct or delete content that breaches these terms, is misleading, illegal or infringes third-party rights. Moderation does not mean that we guarantee the accuracy of what is approved. You can delete your own events at any time from the app; deletion is immediate and permanent.
5. Content you publish
By publishing text, images, logos, links or any other material, you declare that you have the necessary rights or authorizations to do so and that it does not infringe third-party rights. You are responsible for that content.
You grant us a non-exclusive, free and limited license to display, reproduce, technically adapt (for example, resize images) and distribute your content within Ciudad Viva and its promotion channels (site, app, newsletter, Ciudad Viva's social media), for the sole purpose of operating and promoting the platform. This license does not transfer ownership of your content to us or prevent you from using it elsewhere; it ends when you delete the content or your account, except for reasonable residual copies in technical backups.
6. Information from public sources
Event content incorporated from the websites of municipalities or public bodies belongs to its original sources and organizers. Ciudad Viva claims no ownership over that content and may update, correct or remove it if the original source changes or if we detect errors.
7. Verification
“Verified” means that the Ciudad Viva team manually reviewed an organization's legitimacy at a given time. It is not a permanent certification, does not cover each individual event published afterwards, and must not be interpreted as a guarantee that the event will take place, will be safe or will match what was announced. We always recommend confirming important details directly with the organizer before attending.
8. Limitation of liability
Ciudad Viva does not organize, produce or manage events published by third parties, and is not involved in ticket sales or payments. We are not responsible for: cancellations or changes of time or place decided by the organizer; the quality, safety or legality of the event; incorrect or outdated information published by an organizer; or problems with tickets, payments or services of external ticketing platforms.
This does not seek to remove all liability from Ciudad Viva: we are responsible for the proper functioning of our own platform within reasonable limits, and for the content we ourselves incorporate with errors attributable to our processes.
9. Third-party links and services
An event may include links to ticketing sites, social media, maps or other external platforms. Those services are operated by third parties under their own terms; we don't control them and are not a party to the transactions you make on them.
10. Integrations for organizations
We offer organizations the option to connect their own systems to automatically sync events with Ciudad Viva through our integrations API. The organization is responsible for the accuracy of the data its system delivers through this integration, on the same terms as if it published them manually.
11. Acceptable use
By using Ciudad Viva you agree to:
- Not use the platform for unlawful purposes or purposes contrary to these terms
- Not attempt to access, alter or damage the platform's systems or databases
- Not impersonate third parties or publish false or offensive content
- Not use automated systems (bots, scrapers) to extract content from the platform for purposes other than those intended, except through the integrations API offered for that purpose
12. Ciudad Viva's intellectual property
Ciudad Viva's design, brand, source code and features are protected by the intellectual property laws of Chile and applicable international treaties. This does not affect the ownership of the content published by users and organizations (§5) or that of the incorporated public sources (§6).
13. Service availability
Ciudad Viva is a service under continuous development. We may experience interruptions due to maintenance, technical causes or force majeure. We do not guarantee uninterrupted availability.
14. Changes
We may modify, suspend or discontinue features of the platform, and update these Terms or the Privacy Policy when necessary. The last updated date appears at the top of the document; continued use after a change implies acceptance.
15. Termination
We may suspend or close accounts or organizations that breach these terms. You can close your account or organization at any time following the procedure in the Privacy Policy.
16. Governing law
These terms are governed by the laws of the Republic of Chile.
